ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Alcohol will only be sold to persons who order and purchase food.
No alcohol to be consumed on the premises, or sold in open containers.
Alcohol must be sold and supplied in the manufacturers sealed container.
A written policy must be in place to prevent the sale or supply of alcohol to persons under 18 years of age, the policy shall require any person making a delivery of alcohol to accept one of the following forms of identification before completing the delivery:
1 A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
2 British Photo Driving Licence
3 Passport
4 Any other identification approved and accredited in writing by Lincoln Police Licensing Office
All point of sale staff must undergo training in the above policy with a record kept of the date of training, signed by the member of staff and the trainer, each entry shall be retained for a period of 24 months from the date of completion, this record shall be made available for inspection by Lincolnshire Police officers, WLDC Licensing Officers or other parties acting on their behalf.
A written record must be kept of all alcohol orders delivered to include the time and date of order, the person making the order, method of payment, the delivery address and person receiving delivery and whether proof of age was requested and what means of identification was supplied, the name of the person making the delivery and signed by them and endorsed by the DPS.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate;
a) That it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age;
b) That proof of age may be requested at the premises and those accepted means for proof of age listed above.
A secure lockable unit approved by Lincolnshire Police must be inside the delivery vehicle to discreetly transport alcohol out of public view at all times.
A CCTV system shall be installed and (or alternately where such a system is already installed) shall be maintained in working order and operated at the premises to the satisfaction of Lincolnshire Police and must be 'Fit for Purpose' by complying with the following conditions;
A monitor and the recording equipment shall be located in a secure room or other location, which prevents unauthorised access, tampering or removal of images. The system shall be used to record during all hours that the premises are open to the public.
Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.
The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant time and date.
The system shall be capable of monitoring and recording satisfactory colour images from each and every camera continually e.g. Multiplex facility.
The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access areas to toilet facilities.
The recordings shall be provided to officers of Lincolnshire Police on request, officers of Lincolnshire Police shall be permitted access to the system at any reasonable time.
All aspects of CCTV system must comply with the Data Protection Act 1998.
Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the premises.
During all hours that the premises are open or licensable activities are permitted, a member of staff will at all times be on the premises and capable of operating the system in its entirety.
