ANNEX 1 - MANDATORY CONDITIONS
General
The sale and supply of alcohol shall be limited to;
a) Members of the Gainsborough and District United Services Club Ltd admitted to membership in accordance with the club rules;
b) Members and supporters of visiting teams or societies on the occasion of a sporting activity involving that team/society and Gainsborough and District United Services Club Ltd;
c) Those attending any function organised by the club, including those attending bona fide pre booked function organised by the club, or member restricted to the area defined as the Concert Room, this entrance and adjacent lavatory facilities as per the Premises Plan submitted with the application;
A copy of the rules shall be appended to the Premises Licence.
A register of members and a register of visitors shall be maintained and kept available when the club premises certificate is in use for inspection by authorised officers of the Licensing Authority and responsible authorities.
Prevention of Crime and Disorder
The following condition shall only apply when functions are held in the concert room;
There shall be provided at the premises door supervisors who are registered with the Security Industry Authority (SIA) to such a number as the Lincolnshire Police consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for the activity.
A record/log shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor. The record shall contain the following details: -
a) door supervisor's name;
b) his/her Security Industry Authority licence number.
c) the time and date he/she commenced and concluded their duty
The door supervisors shall sign each entry, the designated premises supervisor or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
Each entry shall be retained for a period of 24 months from date of completion.
There shall be no teenage functions at the premises.
Protection of Children from Harm
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 18 years to produce one of the following forms of identification:
· A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
· Photo driving licence
· Passport
· Any other means of identification approved and accredited in writing by Lincoln Police Licensing Office.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate;
a) That it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
b) That proof of age may be requested at the premises and those accepted means for proof of age listed as at 1. above.
All point of sale staff shall undergo training in the above policy with a record kept of the date of training, signed by the member of staff and the trainer.
Each entry shall be retained for a period of 24 months from date of completion.
This record shall be made available for inspection by Lincolnshire Police Officers or other parties acting on their behalf.
The withdrawal of adult entertainment from the application, more detail of the entertainment proposed or the inclusion of the following conditions;
Only ‘Approved adult entertainment’ shall be permitted at the premises
a) ‘Approved adult entertainment’ shall describe entertainment consisting of striptease, wearing of see through material or other performance or entertainment involving nudity.
b) No still or moving photographic or video recordings other than by CCTV monitoring equipment installed for crime prevention purposes shall be made of any performance of ‘approved adult entertainment’.
c) There shall be no images of nakedness, nudity or of any description of a sexually explicit nature to cause offence as to the nature of the entertainment being held on the premises on any external advertising.
d) Performances of an Approved adult entertainment shall not be the subject of any advertising involving the distribution of leaflets, promotion by canvassers or by touting in the street, subject to written approval by Lincolnshire Police undertaking that the premise licence holder shall ensure that all associated litter is collected at the end of each day’s opening hours within any area defined and agreed with Lincolnshire Police.
e) The approved adult entertainment shall not be visible from the street.
f) Any person who can be observed from outside the premises shall be decently dressed.
g) No person either resident, staff, performer, entertainer, visitor or customer under the age of 18 years shall be allowed in any part of the premises whilst an approved adult entertainment is being performed or at any time whilst a rehearsal or audition for such entertainment is being conducted.
h) A clear notice shall be displayed at each entrance to the premises, in a prominent position so that it can easily be read by people entering the premises, saying,
NO PERSONS UNDER THE AGE OF 18 YEARS SHALL BE ADMITTED
i) The approved adult entertainment shall be given only by performers/entertainers who are engaged exclusively for that purpose.
j) No performer shall be allowed to work if they appear to be under the influence of intoxicating liquor and/or drugs.
k) The approved entertainment shall be restricted to dancing and the removal of clothes, there shall not be any other form of sexual activity.
l) There shall be no physical participation between any member of the audience and any other performer.
m) The Licensee, management or anyone concerned in providing the approved adult entertainment shall not encourage or permit the encouragement of the audience to throw money or otherwise gratuities to the performers.
n) No performer shall accept or give any telephone number or business card or note to or from members of the audience.
p) Performers shall be provided with changing room(s) which shall be located so as to be separate and apart from public facilities.
q) No person other than performers and authorised staff shall be permitted in the changing room(s).
r) On arrival each customer shall be provided with a copy of the House Rules, which shall include conditions l) to q) inclusive. A minimum A4 size sign with the House Rules clearly legible shall be securely displayed and suitably protected against any theft, damage or defacement, in at least the following locations:
s) Each performer shall be provided with a copy of these conditions a) to s) inclusive, and the premise licence holder shall ensure each performer is trained so as to be fully aware of the House Rules and the conditions contained therein.
