ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
Remain an active member of the local PubWatch Scheme.
Prevention of Crime & Disorder
Door staff used will have level 1 security and SIA registered.
An amnesty box will be provided at the entrance.
There will be downstairs windows.
There shall be provided at the premises door supervisors who are registered with the Security Industry Authority (SIA) to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for a licensable activity.
A record shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor. The record shall contain the following details:-
(i) name, address;
(ii) date of birth;
(iii) his/her Security Industry Authority licence number.
That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
A log book shall be maintained at the premises, in which shall be recorded the following details:-
(i) the door supervisor’s name;
(ii) his/her Security Industry Authority licence number;
(iii) the time and date he/she starts and finishes duty;
(iv) each entry shall be signed by the door supervisor.
That log book shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
Door supervisors registered with the SIA will remain outside the premises until at least 30 minutes after the last customer has left the premises.
Door supervisors to be positioned at each entrance/exit (other than fire exits) to ensure that no customer leaves with any bottles or glasses or food any container/or wrapper.
In order to comply with the venue’s capacity limit a SIA registered security team must be employed to record and control the number of persons entering the premises.
Adult entertainment shall be subject to the following conditions:-
a) ‘Approved adult entertainment’ shall describe entertainment consisting of striptease, wearing of see through material or other performance or entertainment involving nudity.
b) No still or moving photographic or video recordings other than by CCTV monitoring equipment installed for crime prevention purposes shall be made of any performance of ‘approved adult entertainment’.
c) There shall be no images of nakedness, nudity or of any description of a sexually explicit nature to cause offence as to the nature of the entertainment being held on the premises on any external advertising.
d) Performances of an approved adult entertainment shall not be the subject of any advertising involving the distribution of leaflets, promotion by canvassers or by touting in the street.
e) The approved adult entertainment shall not be visible from the street.
f) Any person who can be observed from outside the premises shall be decently dressed.
g) No person either resident, staff, performer, entertainer, visitor or customer under the age of 18 years shall be allowed in any part of the premises whilst an approved adult entertainment is being performed or at any time whilst a rehearsal or audition for such entertainment is being conducted.
h) A clear notice shall be displayed at each entrance to the premises, in a prominent position so that it can easily be read by people entering the premises, saying,
NO PERSONS UNDER THE AGE OF 18 YEARS SHALL BE ADMITTED.
i) The approved adult entertainment shall be given only by performers/entertainers who are engaged for that purpose.
j) No performer shall be allowed to work if they appear to be under the influence of intoxicating liquor and/or drugs.
k) The approved entertainment shall be restricted to dancing and the removal of clothes, there shall not be any other form of sexual activity.
l) There shall be no sexual activity between any member of the audience with any performer.
m) The Licensee, management or anyone concerned in providing the approved adult entertainment shall not encourage or permit the encouragement of the audience to throw money or otherwise gratuities to the performers.
n) No performer shall accept or give any telephone number or business card or note to or from members of the audience.
o) Performers shall be provided with changing room(s) which shall be located so as to be separate and apart from public facilities.
p) No person other than performers and authorised staff shall be permitted in the changing room(s).
q) A notice containing these rules will be prominently displayed to those entering the club on any evening on which such entertainment takes place.
r) Each performer shall be provided with a copy of these conditions a) to r) inclusive.
The door between the dance floor and lounge on the first floor to be fitted with an emergency exit locking bar mechanism, allowing the door to be closed and locked at 23.00 hours each night when the Pool and Snooker games areas close.
The installation and maintenance of 24 hour CCTV recording facility in the premises with cameras sited in locations after consultation with Lincolnshire Police. The recorded images to be made available for inspection, viewing and retention on request by Officers of Lincolnshire Police or their authorised representatives.
A tamper proof CCTV system shall be installed, maintained in working order and operated at the premises in liaison with and to the satisfaction of Lincolnshire Police and shall be used to record during all hours that the premises are open to the public.
A CCTV camera shall be installed, maintained in working order and operated at the locations marked, “CCTV CAMERA” on the plan of the premises.
Where the recording is on a removable medium (i.e., videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.
The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days.
Any outside area used for the consumption of alcohol shall be fully covered by a CCTV to the satisfaction of Lincolnshire Police.
All CCTV recordings must be made available to Lincolnshire Police on request.
The Licensee and/or person in charge shall not allow any lewd or obscene performances to take place on the licensed premises or allow any lewd or obscene poster, advertisement, film, photograph or programme to be displayed or shown therein.
Real smoke shall not be produced in the premises.
The maximum number of persons, including staff and performers, allowed in these premises shall be restricted to 475 on the lower floor and 425 on the first floor.
A defined area shall be provided for dancing, performances of dance and any entertainment of similar description and this area shall be cleared of all non-permanent fixtures and fittings during the activity.
During such activity all glasses shall be toughened or plastic.
Persons who are dancing in the premises in the designated area shall not be permitted to consume food or drink of any description or possess any lighted cigarette, cigar or object of a similar nature, within that designated area. Appropriate signage to this effect will be displayed on the premises.
Free cold drinking water shall be available at all times on request.
Public Safety
The maximum occupancy limit will be 600.
Fire Safety Regulations will be adhered to and fire safety procedures will be in place.
There will be full coverage by CCTV with a radio link to the town's CCTV control room.
Prevention of Public Nuisance
There will be no admission to people under the influence of drink.
There will be no sales of alcohol under the influence of drink.
There will be a suitable dress code and random searches.
Protection of Children from Harm
Children are not allowed on the premises.
