  No supply of alcohol may be made under the premises licence -:

   

  a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

               

  Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -:

   

  a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supplied alcohol), or

  ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

  b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  i)              the outcome of a race, competition or other event or process, or

  ii)              the likelihood of anything occurring or not occurring;

  e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be

       considered to condone, encourage or glamorise anti-social behaviour or               to refer to the effects of drunkenness in any favourable manner.

   

  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  The responsible person shall ensure that -:

   

  a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  i)              beer or cider: ½ pint;

  ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

  iii)              still wine in a glass: 125 ml; and

  iv)             

  b)              customers are made aware of the availability of these measures.

   

  A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price'.

  'Permitted price' is the price found by applying the formula P = D + (DxV)

  (i) P is the permitted price,

  (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol.

   

  Admission of children to the exhibition of any film must be in accordance with the recommendations of the British Board of Film Classification for that film. Where permission has been given by the Licensing Authority to show a film not classified by the British Board of Film Classification, the requirements made by the Licensing Authority for the admission of children to the exhibition of that film must be followed.

• CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1)              The primary operation of the premises shall be whereby the sale of alcohol is ancillary to the sale of food and hot beverages.

   

  2)              The theme of the venue will be one of a restaurant that predominantly provides seating for all customers with background music only.

   

  3)              The premises shall operate the "Challenge 25" Proof of Age Policy to prevent the sale or supply of alcohol to persons under 18 years of age. The policy shall require any person who appears to be under the age of 25 years to produce one of the following forms of identification:

   

  A recognised proof of age card credited under the British Retail Consortiums Proof of Age Standards Scheme (PASS);

  Photo driving licence;

  Passport;

  Any other means of identification approved and accredited in writing by Lincoln Police.

   

  4)              The supply of alcohol shall primarily be by way of table service. (To remove any doubt table service means that alcoholic drinks shall be delivered to a table, however, orders may on occasion be placed at the bar and delivered directly to customers over the bar.)

   

  5)              There shall be no promotions on the sale or supply of alcohol at the premises that include any multiple promotions i.e. offering discounted drinks relative to the quantity purchased (for example, but not limited to, 2 for 1 deals and the like).

   

  6)              There shall be no seating provided at the bar.

   

  7)              Customers shall be discouraged from standing at the bar.

   

  8)              An incident book shall be kept at the premises.  In which details of the crime and/or disorder relating to the premises shall be recorded. The incident book shall contain the following details;

   

  Time, date and location of incident;

  Nature of incident;

  Names, addresses and contact details of persons involved.

  Result of the incident.

  Action taken to prevent further such incidents;

  Each entry signed by the DPS or other responsible person employed at the premises and so authorised by the DPS; and

  Retained for a period of no less than 12 months and made available to Lincolnshire Police for inspection upon request.

   

  9)              A CCTV system shall be installed and maintained in working order and shall be used to record during all hours authorised for licensable activities.

   

  10)              The CCTV system shall record frontal head and shoulder colour image of all persons entering the premises.

   

  11)              The system shall monitor and record all areas of the premises to which members of the pubic are permitted access.

   

  12)              The monitor and recording equipment shall be located in a secure room or in a secure cabinet to prevent unauthorised access, tampering or removal of images.

  The system shall record between a minimum of 15 frames per second and an optimum of 25 frames per second.

  The quality of the images recorded by the CCTV system shall be such that they are of practical value in the promotion of the licensing objectives by;

  Clearly showing actions of persons involved in a incident;

  Giving evidence of identity of offenders;

  Showing an overall view of the scene.

   

  13)              The images recorded by the CCTV system shall be retained in an unedited form for a period of not less than 31 days and be endorsed with the accurate time and date.

   

  14)              During all hours that the premises are open, a member of staff will be on the premises who is capable of operating the system to review recordings and provide recorded footage on a removal medium.

   

  15)              Recordings shall be provided to officers of Lincolnshire Police or authorised officers of the Licensing Authority upon request. Officers shall be permitted access to the system at any reasonable time.

   

   

  16)              Right to work checks shall be conducted on all potential employees prior to their employment in any capacity at the venue

   

  17)              Conduct those checks in accordance with the Home Office Code of Practice for employers as current at that time

   

  18)              Retain written records of these checks to contain the following information; Date of the checks, identity of the individual (full name; date of birth, country of origin) documents checked and identifying marks; result of the check; date for recheck if required according to the individual status.
